Rideshare crashes add a layer most drivers never see: whose insurance applies depends on what the app was doing at the moment of impact.

Whose insurance covers an Uber or Lyft crash?
It depends on the driver's app status. Offline, only the driver's personal auto policy applies. App on but waiting for a request, the rideshare company's contingent coverage applies at lower limits. En route to a pickup or carrying a passenger, the company's larger commercial liability coverage applies, typically up to $1 million. Establishing app status is often the first fight.
I was a passenger. What are my rights?
Passengers are almost never at fault, which simplifies things, but payment still routes through several layers: your own PIP, the rideshare company's coverage for the trip period, and the other driver's liability coverage if they caused it. Screenshot the trip in your app history immediately, including driver, vehicle, time, and route.
Does it matter that the driver is an independent contractor?
Uber and Lyft classify drivers as independent contractors, which they use to limit direct company responsibility for the driver's conduct. That is why the trip-period insurance coverage, rather than an employment theory, usually does the work in these claims. It makes documenting the app status critical.
Should I accept an early offer from the app's insurer?
Rideshare claims are handled by third-party administrators who sometimes offer quick settlements before the full extent of injuries is known, and a signed release generally ends the claim permanently. Treatment that continues for months after the crash cannot be revisited once you sign.
How long do I have to file?
Florida's filing deadline for negligence claims was shortened by the 2023 tort reform legislation, and the window that applies depends on your date of injury and the type of claim. Claims involving a government vehicle or property carry separate, much shorter notice requirements. Confirm your exact deadline with an attorney rather than assuming you have years.
