St. Petersburg slip and fall lawyer.

Store aisles, hotel lobbies, stairwells, parking lots. Florida property owners have real responsibilities, and a fall case turns on what they knew and what you can prove.

Is a business automatically responsible when I fall?

No. Florida law generally requires showing the business knew about the dangerous condition or that it existed long enough that it should have known, and then failed to fix or warn about it. A spill that was just knocked over is treated differently than a leak someone walked past for an hour. That is why evidence about how long the hazard was there matters so much.

What should I do right after falling in a St. Petersburg store?

Report it to a manager before you leave and ask for a written incident report and a copy. Photograph the exact spot, the substance or defect, the lighting, and any missing warning sign, from several angles. Get names of employees and witnesses, keep the shoes you wore, and see a doctor promptly so your injuries are documented.

Does security video exist, and how long does it last?

Most Florida retailers, restaurants, and hotels record the area, but many systems overwrite footage within days or weeks, and companies often preserve only a short clip. A prompt written request that the business preserve the full video is one of the more time-sensitive steps in a fall case.

What if I was partly at fault?

Florida uses a comparative fault system, and under the 2023 changes a plaintiff found more than 50 percent at fault in a negligence case is generally barred from recovery. Insurers lean hard on distraction, footwear, and ignored signs for exactly that reason. Being partly careless does not automatically end a claim, but how fault is apportioned drives the outcome.

How long do I have to file a Florida fall claim?

Florida's filing deadline for negligence claims was shortened by the 2023 tort reform legislation, and the window that applies depends on your date of injury and the type of claim. Claims involving a government vehicle or property carry separate, much shorter notice requirements. Confirm your exact deadline with an attorney rather than assuming you have years.
